Terms of Service

Welcome to Oven and Flame. By placing an order or using our Site, you agree to these Terms of Service.

Ordering

• All orders are custom-made to your specifications and require a minimum of 5 business days’ notice before your requested pickup or delivery date.
• When you place an order, you are making an offer to purchase. Your order is confirmed once payment is completed and you receive an order confirmation.
• You are responsible for the accuracy of the details you provide, including flavor, size, layers, extras, date, and delivery address. We prepare your cake based on the information you submit.

Ordering paths, pricing, and payment

We offer two ways to order:

• Instant checkout: For cakes without custom extras, the price shown on the Site is firm and is payable in full at checkout.
• Custom orders (quote requests): For cakes with custom extras, decoration, multi-tiered designs, or other special work, you submit a request with your requirements and any reference photos. No payment is taken at the time of request. We review your request and provide a quoted price. If you accept, a deposit of 50% of the quoted total is required to confirm your order and reserve your date. The remaining balance is due before pickup or delivery.

General payment terms:

• Payment is processed securely through Stripe. We do not store your card details.
• Delivery fees, where applicable, are calculated based on the driving distance from our location to your delivery address and are shown before you complete checkout or as part of your quote.
• A quoted price is valid for 14 days and is subject to our availability on your requested date.
• We reserve the right to correct pricing errors. If a price is listed incorrectly, we will contact you before charging you or fulfilling the order.

Pickup and delivery

• Pickup: You may collect your order in Tamarac, FL on your selected date during our operating hours. We provide the exact pickup address ahead of your scheduled date. Please bring your order confirmation.
• Delivery: We deliver within 30 miles of our location. Someone must be available to receive the cake at the delivery address on the scheduled date. We are not responsible for damage that occurs after a cake has been successfully delivered and received.

Custom and perishable goods

Our cakes are made fresh to order and are perishable. Because each cake is custom-made for you, orders are subject to the cancellation and refund terms in our Refund and Cancellation Policy.

Product appearance

We take great care to match your order, but because every cake is handmade, slight variations in color, decoration, and finish may occur. Photographs on the Site are representative and not exact guarantees of appearance.

Any reference photos you upload with a quote request are used as inspiration to guide the design. Because each cake is handmade to order, the finished cake is our interpretation of your request and will not be an exact match or reproduction of the images you provide.

Allergens

Please read our Allergen Disclaimer carefully before ordering. You are responsible for informing us of allergies and for making informed decisions about consuming our products.

Custom quote requests

Custom, multi-tiered, and bespoke orders are quoted individually based on the requirements and reference photos you provide. A quote does not constitute a confirmed order until you accept it and pay the required 50% deposit. We reserve the right to decline any request.

Limitation of liability

To the fullest extent permitted by law, Oven and Flame’s total liability for any claim relating to an order is limited to the amount you paid for that order. We are not liable for indirect or consequential damages.

Governing law

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. Any disputes will be handled in the courts located in Broward County, Florida.

Changes

We may update these Terms from time to time. Continued use of the Site after changes take effect constitutes acceptance.
